You may be qualified for temporary disability (T.D.) payments if your work injury stops you from performing your regular job while you’re recovering. If you meet the following criteria, you may be eligible to receive payments equal to 2/3 of your weekly average income:
• Your company does not provide you with alternate work that pays your regular earnings while you recover.
• Our examining physician suggests that you are totally disabled and cannot perform any work at all.
If the workers’ compensation claim is delayed, the carrier has 90 days from the date of
knowledge of your claim to investigate and make a decision regarding acceptance or denial.
During this delay period, our law office will ensure that the workers’ compensation insurance
company pays up to $10,000 in medical care.
If your worker’s compensation claim is denied, the insurance carrier is not required to pay
temporary disability benefits or provide medical care. The firm will utilize its resources to find a
treating physician who will accept the workers’ compensation claim and medical expenses on a
lien basis. The claim will likely settle or proceed through litigation and trial.
If a workers’ compensation claim benefits settlement is proposed before trial, a recommendation to
accept or proceed with the trial will be made. Our office will wait until you have achieved
maximum medical improvement if a settlement is accepted. A medical report will indicate your
percentage of permanent disability and future medical expenses and care needs. Both are used
to calculate the approximate value of your claim, and then a settlement demand is formulated.
